Limited Manufacturer Warranty
Kinesis Gaming (“Kinesis”) warrants to the original retail purchaser that the Kinesis product is free from defects in materials and workmanship and will perform substantially in accordance with the Product documentation. This warranty only applies to the original retail purchaser of the product and requires proof of purchase. Unless otherwise noted in writing, the warranty term shall be set as follows from original date of purchase:
Freestyle Edge: 2 Years
All other products: 1 Year
- This Warranty does not apply to any software included with the product which is covered by the Kinesis License Agreement.
- If the product fails due to accident, abuse, inappropriate use, or normal wear, Kinesis shall have no responsibility under this Limited Warranty
- As with all third-party computer peripherals, compatibility issues may arise, especially as new operating systems and updates are released, that result in certain “bugs” that are characterized by a range of diminished performance by the product. Kinesis will endeavor to fix bugs as they arise but cannot warrant that all bugs will be fixed.
Purchaser’s Exclusive Remedies
During the term of the warranty, the exclusive remedy for a defect in the product shall be, at Kinesis’s option, either repair or replacement of the product. Kinesis has the option to use either new or reconditioned parts or products.
Contacting Technical Support
If you suspect that your Kinesis product is not working properly or if you have questions, contact Kinesis technical support (firstname.lastname@example.org). Kinesis support will attempt to diagnose the problem, determine whether your product is under warranty, and recommend an appropriate course of action.
Return Merchandise Authorization (RMA)
If Kinesis determines that a warranty repair or replacement of the product is required, Kinesis will provide an RMA number and instructions for returning the product to Kinesis. You are responsible for the cost of shipping the product to Kinesis. Kinesis does not accept responsibility for products that are damaged en route to Kinesis so please consider obtaining insurance from your carrier. If a product is damaged or destroyed during shipping that may invalidate your warranty claim.
Kinesis will provide complimentary return shipping (via “UPS Ground” or equivalent) to the United States and Canada for any products that are repaired or replaced under warranty. Customers located outside the US and Canada will be billed Expedited UPS (or equivalent) rates for return shipping.
Disclaimer of Other Warranties
The warranty and remedies set forth above are exclusive and in lieu of all others, whether oral or written, express or implied. Kinesis specifically disclaims any and all implied warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose. No Kinesis dealer, agent, or employee is authorized to make any modification, extension, or addition to this warranty. Kinesis does not warrant that the product will meet your requirements, or that operation of the product will be uninterrupted or error-free, or that all errors will be corrected.
Limitation of Liability
Kinesis is not responsible for special, incidental, or consequential damages resulting from any breach of warranty, or under other legal theory, including but not limited to lost profits, downtime, goodwill, damage to or replacement of equipment and/or property nor any costs of recovering, reprogramming, or reproducing any program or data stored in or used with Kinesis products. Some states or countries do not allow the exclusion or limitation of incidental or consequential damages or exclusions of implied warranties, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state and country to country.
